Dog Date™ is owned and operated by Dog Date Ltd.

These are the terms and conditions for:

  • Dog Date mobile application (Available on Google Play and App Store).

The following terms and conditions apply to your use of the Dog Date™ mobile application. By downloading and installing the application on your mobile device, you agree to these terms and conditions, our privacy policy, our refund policy, our limitation of liability policy, and any other legal notices posted by Dog Date on the platform.

In these terms and conditions, the words 'platform' and 'application' refer to the Dog Date mobile application, 'we,' 'us,' 'our,' and 'Dog Date' refer to Dog Date™, and 'you' and 'user' refer to you, the user of Dog Date.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE DOWNLOADING, INSTALLING, AND USING THE PLATFORM.

1. ACCEPTANCE OF TERMS

By downloading, installing, and using the Dog Date platform, you agree to be fully bound by the terms and conditions set forth in this agreement. If you do not agree to any of the terms, you must refrain from using the platform. We reserve the right to modify this agreement at any time. Any modifications will be effective upon posting on the platform. By continuing to use Dog Date following the posting of a modification, you expressly agree to be bound by the updated terms. For this reason, we recommend that you review this agreement periodically to stay informed of any changes.

By using the platform, you represent and warrant that you have full legal capacity, power and authority to enter into this agreement and to perform your obligations hereunder. You further confirm that you are not subject to any legal, contractual or other restriction that limits or prevents your ability to accept these terms and conditions. You warrant that you will use the platform in accordance with applicable laws and regulations and that your use will not infringe any third party rights or contravene any applicable regulations.

Your acceptance of this agreement constitutes a binding commitment by you and any entity you represent to adhere to the terms set forth herein and any additional policies posted on the platform. This commitment includes your obligation to ensure that all information provided during registration and use of the platform is truthful, accurate and up to date. Dog Date will not be liable for any breach of these terms by users, and any violation of these terms may result in the suspension or termination of your access to the platform.

2. NOTIFICATIONS AND COMMUNICATIONS

By registering and using the Dog Date platform, the user expressly consents to the sending of notifications related to the operation of their account, the use of the application's features, and commercial or marketing communications. These notifications may be sent through messages within the app and via emails sent to the address registered by the user. Such communications may include notifications about matches, messages received, payment confirmations, verification status, platform updates, new features, promotions or advertising content.

The user may manage their preferences regarding non-essential notifications from the settings section of their account, activating or deactivating the categories they wish. With regard to emails for promotional or informational purposes, the user may opt out of receiving them by clicking on the 'unsubscribe' link available in each email.

However, some operational or administrative notifications necessary for the functioning of the service, such as password recovery, security alerts or transaction confirmations, may continue to be sent while the user keeps their account active. Dog Date provides these management mechanisms in order to ensure a personalised experience without compromising access to information essential for the security and proper use of the platform.

3. DESCRIPTION OF THE PLATFORM

Dog Date is a mobile application designed to facilitate connections between dog owners interested in promoting responsible breeding and organising social gatherings for pets. The platform allows users to create detailed profiles of their dogs, add videos and images, include information such as breed, temperament, medical history, and location, and attach relevant documentation such as vaccination certificates and pedigree records. These profiles can be used to search for compatible dogs, either for breeding purposes or to schedule playdates.

Dog Date provides filtering, viewing, and communication tools that allow users to identify potential matches, unlock compatible profiles, access certain documents under specific conditions, and communicate via an internal messaging system. Some additional features, such as priority profile review or early access to featured matches, may be available for specific fees or subscriptions. The platform does not participate in the meetings or genetic verification of the dogs, limiting itself to providing a digital environment in which users can interact on their own responsibility.

4. REGISTRATION AND USER PROFILE

To use the features of Dog Date, users must register by creating a personal account through the mobile app, providing accurate, complete, and up-to-date information. The registration process involves, at a minimum, creating a user profile and setting up login credentials, such as a valid email address and a secure password. Users agree to keep their credentials confidential and not to share their account with third parties. Any activity carried out from their account will be presumed to have been carried out by the account holder, who will be solely responsible for its use, whether authorised or not.

Once registered, the user may create one or more profiles for their dogs, including information such as name, age, breed, temperament, medical history, photographs and related documentation. The uploading of certain documents, such as vaccination certificates or breed registrations, may be a mandatory requirement to access certain matching features or to complete the profile verification process. All information provided must be accurate, current and accurately reflect the characteristics of the animal, with the user being fully responsible for its content.

Dog Date reserves the right to review, approve or reject profiles that do not comply with the requirements of truthfulness, consistency or that violate the rules of use of the platform. It may also suspend or delete accounts that show fraudulent activity, misuse of services, publication of false information or that violate these terms and conditions.

The user may delete their account at any time by accessing their profile settings within the application. When you delete your account, your profile will be deactivated and all associated data will be deleted, except for data that must be retained for legal, contractual or security reasons in accordance with the privacy policy. Deleting your account means you will permanently lose access to active matches, message history and any features linked to your user profile.

5. DOCUMENT AND PROFILE VERIFICATION PROCESS

To ensure a safe, reliable environment focused on responsible breeding and animal welfare, Dog Date requires that all dog profiles undergo verification before being published or enabled for matching. This verification is carried out by manually reviewing the mandatory documents provided by the user when creating their dog's profile. The user can choose between two types of verification process:

Standard verification:

  • Free
  • Review of the profile and documents within 72 working hours of submission
  • Applicable by default when completing the dog's registration

Priority verification:

  • One-time fee of £4.99
  • Expedited review of the profile and documents within a maximum of 24 hours
  • Available as an option when uploading the documentation

If the user provides incomplete, illegible, incorrect or non-compliant documentation, they will be notified to resubmit it. This resubmission will restart the verification period, which may be extended again up to a maximum of 72 hours from receipt of the corrected documentation. The profile will not be published or activated until the document validation process has been successfully completed.

The documents required for verification are as follows:

  • Dog breed certificate (where applicable)
  • Up-to-date compulsory vaccination records
  • Proof of flea or parasite treatment
  • Optionally, a document certifying the animal's inbreeding coefficient, in the case of responsible breeding

Dog Date reserves the right to reject any document that does not meet the minimum criteria of authenticity, clarity or integrity, as well as to suspend the verification of profiles that contain fraudulent, manipulated or incompatible information with the principles and objectives of the platform. The review of documents is limited to a formal and superficial validation of the files provided and does not constitute a genetic, medical or veterinary certification of the animal.

Verification is carried out through a combination of manual review by the Dog Date team and the use of automated technological tools, including artificial intelligence systems provided by third parties, which assist in detecting formal inconsistencies and analysing the integrity of the files submitted. These tools are used as technical support, but do not replace the user's final judgment regarding the validity and authenticity of the documentation.

Dog Date does not certify or guarantee the genetic, medical, or legal authenticity of the documents submitted, and the review is based solely on the information provided by the user. The user declares that all documents uploaded to the platform are true, complete, and up to date. Dog Date expressly disclaims any liability arising from errors, omissions, falsehoods, or manipulations in the documents submitted, as well as any consequences that may result from the use of or reliance on the verified information. The platform acts as a facilitator of the process, but not as a verifying or certifying authority for the information provided by users.

The user understands and accepts that profile verification does not confer any guarantee regarding the health, temperament, lineage or behaviour of the animal, and that Dog Date acts solely as a facilitator of the platform, without intervening or assuming any responsibility for the consequences of matchmaking, interactions between users or encounters arising from the application. The priority verification fee may be subject to change at any time at Dog Date's discretion, without affecting verifications already requested and paid for prior to the change.

6. DOCUMENT VISIBILITY RULES

In order to protect user privacy and ensure responsible use of the information shared on the platform, Dog Date applies specific restrictions regarding the visibility of documents uploaded during the dog profile creation and verification process. The documentation submitted by users, including vaccination certificates, breed certificates, antiparasitic treatments and any other medical or genetic information, will not be publicly visible or generally available to other users of the platform.

Access to these documents is strictly conditional upon the following requirements being met:

  • There must be a mutual match between two profiles, voluntarily confirmed by both parties.
  • The user must have correctly completed the payment corresponding to the match, according to the access model selected (pay-per-use or active subscription).

Once both conditions have been met, access to the other party's previously verified documents will be enabled to allow for an informed and responsible review before arranging a meeting for breeding or socialisation purposes. Dog Date does not allow free or advance consultation of this information as a security measure, for confidentiality and to prevent misuse of sensitive data.

If a user requires additional information or wishes to obtain clarification on the documents submitted by another owner, they must make the request directly to their counterpart through the platform's internal messaging system. Each user is responsible for deciding what additional information they wish to share and under what terms.

Dog Date reserves the right to restrict or revoke access to documents at any time if it detects misuse, attempted impersonation, unauthorised access or any behaviour contrary to the platform's rules. Users are also reminded that all documentation shared must be legitimate, current and consistent with the stated purposes of the profile.

7. PAYMENT AND SUBSCRIPTION STRUCTURE

Dog Date offers various access options to its features depending on the user's objectives, distinguishing between pairings aimed at responsible breeding and pairings for play dates. Each option has specific payment terms, feature activation and deadlines for confirming profile compatibility. All fees are expressed in British pounds (£) and may be changed at any time by Dog Date without affecting transactions initiated prior to the change. Updated prices will be published in the app and will only apply prospectively.

For breeding matches, users may access the service on a pay-per-use basis under the following conditions:

  • £9.99 per match
  • The initial charge is processed by pre-authorising the corresponding amount
  • The match is only unlocked if both owners confirm their interest and complete payment within a maximum period of 48 hours
  • If the match is not confirmed within this period, it will automatically expire and no charge will be made

For matches aimed at organising playdates, users can choose between two options:

Basic plan (pay-per-use):
  • £4.99 per match
  • Aimed at users who prefer a one-off, flexible option
  • Includes: unlocking chat with the other user and access to match documents once payment has been processed
  • Payment is only processed if both parties confirm the match within 48 hours
Paws Premium Subscription:
  • £8.99 per month
  • By purchasing the subscription, the user expressly authorises automatic monthly renewal via the payment method provided at the time of purchase
  • The recurring charge will be made on the same date each month (or the next business day, as applicable) and will continue until the user cancels
  • The user may cancel the subscription at any time from their account by accessing the settings section in the billing area. Cancellation will take effect at the end of the current billing period, remaining active until then without partial refunds for unused periods.

All transactions made on Dog Date are managed through external and secure payment providers, and it is the user's responsibility to ensure the validity and sufficiency of the registered payment method. Dog Date reserves the right to suspend access to features linked to any payment method in the event of billing failures, rejected charges, fraudulent use or breach of these terms and conditions. The purchase of matches or the subscription to a service does not guarantee the existence of compatible matches, nor does it commit Dog Date to generating specific results.

8. USER CONTENT

Dog Date allows users to upload, publish and share content within the platform, including but not limited to images of dogs, profile descriptions, behavioural characteristics, medical information, certificates, messages in the messaging system and any other data or files that the user voluntarily enters. By using these features, the user represents and warrants that they own all necessary rights to the content they share, or that they have sufficient authorisation to publish it, and that such content does not infringe the rights of third parties or violate any applicable regulations.

The user retains ownership of the content they upload, but grants Dog Date a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to store, host, use, reproduce, distribute, publicly display, adapt and process such content to the extent necessary for the proper provision and operation of the platform. This licence remains in force while the content remains on the platform and expires upon its removal, except in cases where Dog Date must retain a backup copy to comply with legal obligations, resolve disputes or prevent fraud.

The user is solely responsible for the content they publish or transmit through the application and undertakes not to upload or share any material that is unlawful, offensive, fraudulent or contrary to the legitimate purposes of Dog Date. In this regard, it is strictly prohibited to upload or disseminate the following types of content:

  • Content that is false, misleading, fraudulent or misrepresents the identity, characteristics or condition of the dog
  • Images or descriptions with violent, explicit or inappropriate representations for the platform environment
  • False or manipulated medical information with the intention of misleading about the animal's health or history
  • Altered, falsified or expired documents
  • Content that infringes on the intellectual or industrial property rights of third parties
  • Sensitive personal information, such as address, telephone number or financial data, that has not been properly blurred or protected
  • Any type of hate speech, threats, harassment, defamation or discriminatory content based on race, gender, sexual orientation, religion or any other condition
  • Unauthorised advertising, promotions, external links, surveys or content for commercial purposes unrelated to the platform
  • Malicious code, viruses, bots or any other technical mechanism that alters, interferes with or impairs the security or functioning of Dog Date

Dog Date reserves the right, but not the obligation, to monitor, review, moderate, edit or remove any content that, in its sole discretion, violates these terms or violates the integrity of the community. Likewise, Dog Date may suspend or cancel the account of any user who repeatedly posts inappropriate content, without prior notice.

The user acknowledges that the content posted may be visible to other users depending on the matching and visibility mechanisms of the platform, and that they must act at all times with responsibility, respecting the rules of coexistence and the legitimate purpose of the service.

9. CHAT AND MESSAGING

Dog Date provides users with an internal messaging system that allows direct communication between compatible profiles once a valid match has been confirmed. This feature is intended solely to facilitate the exchange of relevant information about the matched dogs, to allow the coordination of face-to-face meetings and to encourage respectful interaction between owners. Access to the chat is only enabled after mutual acceptance of a match and, where applicable, fulfilment of the corresponding payment requirements.

The messaging system is an integral part of the platform and is subject to these terms of use. Messages, files and images shared through the chat must be appropriate, relevant and related to the purposes for which the platform has been designed. Dog Date does not actively monitor the content of messages, but reserves the right to access, review or delete communications if it receives reports, has reasonable suspicion of misuse, or is required to do so by law. Users are responsible for everything they communicate or share through the system and must act with honesty, respect and good faith.

It is strictly prohibited to use the messaging system to:

  • Send offensive, threatening, defamatory, harassing or discriminatory content
  • Share unsolicited images or files of a sexual, violent or inappropriate nature
  • Promote the unethical or illegal use of animals, including irresponsible breeding practices or practices contrary to animal welfare
  • Request sensitive personal data such as telephone numbers, addresses, bank details or other means of direct contact outside the platform
  • Disseminate commercial content, external links, advertisements or invitations to other services unrelated to Dog Date
  • Pretend to be someone else or create fake profiles to deceive, manipulate or defraud other users
  • Intimidating, pressuring or harassing other users to obtain information or achieve unwanted matches
  • Share or request falsified, manipulated or inaccurate documentation that does not correspond to the verified profile

Failure to comply with any of these conditions may result in the temporary or permanent suspension of access to the chat, the removal of the match, and even the cancellation of the offending user's account, without any right to a refund. Dog Date reserves the right to retain limited records of conversations if necessary for investigation, legal compliance, dispute resolution or protection of the integrity of the community.

Users should remember that, although the platform provides a controlled environment, Dog Date does not participate in conversations and is not responsible for the decisions, interactions or agreements that arise as a result of communications between users. It is recommended to act with caution, maintain privacy and refrain from sharing information that you are not willing to disclose under your sole responsibility.

10. RECOMMENDATIONS FOR DOG BREEDING

Dog Date offers a matching service designed to facilitate connections between dog owners for responsible breeding purposes. However, the decision to proceed with breeding is solely up to the users, who must exercise their own due diligence.

The following recommendations are provided for informational purposes only and are not binding. They are intended to provide guidance for this process. Dog Date does not guarantee successful breeding results and assumes no responsibility for reproductive outcomes, medical issues, or disputes between users.

10.1. Prerequisites for breeding

Before beginning any breeding process, owners must ensure that their dog is in optimal condition:

Appropriate age and maturity:
  • Males: breeding is recommended between 18 months and 5 years of age.
  • Females: breeding is not recommended before the third heat or after 6 years of age, unless otherwise indicated by a veterinarian.
Prior veterinary evaluation:
  • A recent, comprehensive medical examination confirming the animal's good health is recommended.
  • Common tests include hip and elbow evaluations, heart and eye exams, and breed-specific genetic testing.
  • In addition, the animal must be free of parasites (fleas, ticks, worms) and have all vaccinations up to date.

10.2. Recommended documentation

To ensure transparency and accountability in the process, we suggest having the following documents available:

  • Breed certificate issued by a recognised entity.
  • Veterinary history with evidence of good health and genetic testing if applicable.
  • Microchip registration.
  • Vaccination certificates.
  • In some cases, a letter of authorisation from the veterinarian to proceed with breeding.

Dog Date does not verify the genetic authenticity or guarantee the reliability of these documents; they are reviewed based on the clarity of the information provided by users.

10.3. Ethical and genetic considerations

Users should consider the following aspects before breeding:

  • Assess the inbreeding coefficient (COI) to avoid mating dogs with close genetic links.
  • Refrain from mating dogs that could compromise the genetic health of the puppies.

10.4. Obligations and agreements between owners

Breeding must be the result of a mutual agreement between both owners. It is recommended that a written agreement be formalised to regulate:

  • The distribution of the puppies.
  • The fees for use of the stud dog, if any.
  • Responsibility for veterinary expenses or any complications.

10.5. Timing of the reproductive cycle

Females usually come into heat every six months, with the fertile period estimated to be between days 10 and 14 of the cycle. It is the responsibility of users to coordinate the timing appropriately to facilitate successful mating.

10.6. Financial transparency

The owners of the stud dogs must clearly inform the user of any applicable fees and specify what they include (e.g. additional attempts, fertility guarantees, etc.). Dog Date does not intervene in the negotiation process or in the fulfilment of these agreements.

10.7. Safety and privacy protection

For the safety of both parties:

  • Health documents and certificates should only be shared once the mating has been confirmed.
  • It is recommended that meetings be arranged in safe places, preferably in the presence of a veterinarian or at authorised centres.

10.8. Limitations and expectations

Users are reminded that even when all medical and reproductive conditions are met, there is no guarantee of pregnancy. Dog reproduction is a complex and natural process that can be influenced by multiple factors such as stress, compatibility, environmental and genetic conditions, and the exact timing of the cycle. Dog Date offers no guarantees and accepts no responsibility for failure to conceive, problems during pregnancy, or the genetic or health quality of the puppies born. Users must be fully aware of these limitations before deciding to proceed with breeding.

11. ACCEPTABLE USE AND COMMUNITY GUIDELINES

Dog Date is a platform designed to promote responsible, respectful and safe interactions between dog owners interested in ethical breeding and socialising their pets. Use of the platform implies the user's commitment to act in accordance with the principles of good faith, mutual respect and legality, both in the publication of profiles and in interactions within the system. Failure to comply with these rules may result in the suspension, cancellation or permanent deletion of the offending user's account, without prior notice and without the right to a refund.

The user undertakes to use the application exclusively for the purposes for which it has been developed and shall refrain from any conduct that threatens the integrity of the community, animal welfare, the accuracy of the information published or the safety of other users. In particular, the following is prohibited:

  • Creating false or fraudulent profiles or profiles containing misleading information about the user or their pet
  • Using images or documents that have been altered, manipulated or do not correspond to the reality of the dog or the owner
  • Publishing or disseminating content that is offensive, discriminatory, violent, sexually explicit or inappropriate for a respectful environment
  • Sending messages for the purpose of harassing, intimidating, pressuring or blackmailing other users
  • Promote, participate in or facilitate unethical or irresponsible breeding practices or practices that compromise the welfare of animals
  • Publicly share sensitive personal data or direct contact details (telephone number, address, social media accounts) or request such information from other users
  • Use the platform for commercial, promotional or advertising purposes unrelated to the legitimate objectives of Dog Date
  • Manipulate the matching system, create multiple accounts to gain an advantage or circumvent verification processes
  • Interfere with the technical functioning of the platform, introduce viruses, bots or any other malicious code
  • Violate intellectual property rights or use images or content without proper authorisation

Dog Date reserves the right to monitor, investigate and sanction any behaviour that, in its sole discretion, is incompatible with this code of acceptable use or jeopardises the experience, safety or trust of the community. Continued use of the platform implies express acceptance of these guidelines and a commitment to contribute to a safe, authentic environment that is respectful of animals and their owners.

12. LICENSE TO USE THE PLATFORM

Dog Date grants the user a personal, worldwide, royalty-free, non-transferable, non-sublicensable, non-exclusive, non-sublicensable license to download and use the Dog Date mobile application, available through the App Store and Google Play Services. This license includes access to modified versions, updates, upgrades, enhancements, extensions, add-ons and copies of the app, if available. The exclusive purpose of this license is to allow the user to access and use the functionalities offered by the platform in accordance with the terms and conditions set forth in this agreement.

The user agrees to use the platform diligently, lawfully and in full compliance with applicable regulations, refraining from any activity that is negligent, fraudulent, harmful or in any way compromises the integrity of Dog Date, its services or the experience of other users. Use of the platform for actions that may damage the reputation, interests or rights of Dog Date, its affiliates or third parties is strictly prohibited, including but not limited to:

  • Attempting to access unauthorised systems or reverse engineer the platform.
  • Employ automated techniques to interact with the platform in an unauthorised manner.
  • Engage in activities that may disrupt, overload or compromise the technical operation of the platform.

Dog Date reserves the right, at its sole discretion, to suspend or terminate the user's access to the platform immediately and without liability to the user, in the event that any breach of the stated conditions is detected. This cancellation may be carried out with or without prior notice, depending on the nature and severity of the breach. In addition, Dog Date reserves the right to take legal action if the improper use of the platform generates economic, technical or reputational damage to the company or third parties.

The user acknowledges that the license granted is revocable and that its continuity depends on full compliance with these conditions. Any unauthorised or prohibited use of the platform may result in the immediate termination of this license and the adoption of the necessary legal measures to protect the rights and interests of Dog Date.

13. COPYRIGHT

All rights, titles, and interests related to the Dog Date application, including but not limited to its source code, design, interface, structure, logos, graphics, trade names, trademarks, audiovisual content, interactive elements, databases, texts, sounds, and any other component incorporated into the application, are the exclusive property of their respective owners and are protected by applicable intellectual property and copyright laws. Any reproduction, distribution, modification, adaptation, translation, publication, display, stream, broadcast, or exploitation, in whole or in part, of the contents or elements of Dog Date without the prior express written consent of the owner is expressly prohibited. Use of the application does not grant the user any ownership rights, license, or authorisation over the protected rights, except those strictly necessary for the legitimate use of the application in accordance with these terms and conditions. Any unauthorised use of the protected elements may result in civil or criminal legal action, as appropriate. Dog Date reserves all rights not expressly granted in this document.

14. COPYRIGHT COMPLAINTS

Dog Date will respond to all enquiries, complaints and claims relating to alleged infringements of the provisions contained in UK and international laws and regulations on copyright and intellectual property. Dog Date respects the intellectual property of third parties and expects users to do the same. If you believe, in good faith, that any material provided on the platform infringes your copyright or other intellectual property rights, please send your request via our contact information, with the following information:

  • Identification of the intellectual property right that is allegedly infringed. All relevant registration numbers, or a statement concerning the ownership of the work, should be included.
  • A statement specifically identifying the location of the infringing material, with enough detail that Dog Date may find it on the platform.
  • Your name, address, telephone number and e-mail address.
  • A statement by you that you have a good faith belief that the use of the allegedly infringing material is not authorised by the owner of the rights, or its agents, or by law.
  • A statement by you, made under penalty of perjury, that the information in your notice is accurate, and that you are the copyright owner or authorised to act on the copyright owner's behalf.
  • An electronic or physical signature of the owner of the copyright or the person authorised to act on behalf of the owner of the copyright interest.

15. PROHIBITED ACTIVITIES

The following activities are prohibited:

  • Access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy or otherwise exploit any content of the platform, including, but not limited to, using any robot, spider, scraper or other automated means or any manual process for any purpose not in accordance with these terms.
  • Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.
  • Deep-link to any part of our platform for any purpose without our express written permission.
  • "Frame", "mirror" or otherwise incorporate any part of the platform into any other platform or service without our prior written permission.
  • Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software used by Dog Date.
  • Evade, disable or otherwise interfere with security-related features of the platform or features which prevent or restrict the use or copying of any content.

16. LIMITATION OF LIABILITY

Dog Date, its affiliates, officers, employees, and contractors shall not be liable in any case for indirect, incidental, special, punitive, or consequential damages, including, without limitation, loss of profits, business interruption, loss of data, or any other damages arising out of or relating to the use of the platform, even if advised of the possibility of such damages.

To the extent permitted by applicable law, Dog Date's total liability to any user for any claim, damage, loss or cause of action arising from the use of the platform, the services or these Terms and Conditions, whether in contract, tort (including negligence), strict liability or any other legal basis, shall be strictly limited to the total amount actually paid by such user to Dog Date for subscription or services during the twelve (12) month period immediately preceding the event giving rise to the claim.

17. DISCLAIMER OF WARRANTIES

Due to the nature of the Internet, Dog Date provides and maintains the platform on an "as is", "as available" basis and does not promise that use of the platform will be uninterrupted or error free. We shall not be liable to the user or any third party if we are unable to provide our platform and services for any reason beyond our control.

Our platform may from time to time contain links to other platforms which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.

Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

You will be responsible for any breach of these terms by you and if you use the platform in breach of these terms you will be liable to and will reimburse Dog Date for any loss or damage caused as a result.

Dog Date shall not be liable for any amount for any failure to perform any obligation hereunder if such failure is due to the occurrence of any unforeseen event beyond its reasonable control, including, without limitation, Internet outages, communications outages, fire, flood, war or force majeure.

These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, Dog Date excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Dog Date and Dog Date shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

  • Any incorrect or inaccurate information on the platform.
  • The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the platform or any product purchased through the platform.
  • Any loss or damage resulting from your use or the inability to use the platform or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control.
  • Any loss of profit, wasted expenditure, corruption or destruction of data.
  • Any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing or using content from the platform or from transmissions via emails or attachments received from Dog Date.
  • All representations, warranties, conditions and other terms which but for this notice would have effect.

18. INDEMNIFICATION

You agree to defend and indemnify Dog Date and any of their directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • Your breach of this agreement or the documents referenced herein.
  • Your violation of any law or the rights of a third party.
  • Your use of the platform.

19. CHANGES

We may change the platform and these terms at any time, in our sole discretion and without notice to you. You are responsible for remaining knowledgeable about these terms. Your continued use of the platform constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms. Unless otherwise specified herein, all changes to these terms apply to all users take effect.

Any personal information you submit in connection with your use of the platform as a user will be used in accordance with our privacy policy. See our privacy policy.

21. INTEGRATION CLAUSE

This agreement of terms and conditions, together with the privacy policy, refund policy, the limitation of liability document and any other legal notices published by Dog Date on the platform, shall constitute the entire agreement between you and Dog Date in relation to your use of the platform and shall govern such use. Registration and use of the Dog Date platform indicates acceptance of these policies and legal notices.

22. SEVERABILITY

If any section of these terms is held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. Our failure to enforce or delay in enforcing any provision of these terms at any time does not waive our right to enforce the same or any other provision in the future.

23. FORCE MAJEURE

Dog Date shall not be liable for any failure to perform due to causes beyond its reasonable control, including, without limitation, fortuitous events, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature and natural disasters, and other acts that may be due to unforeseen circumstances.

24. TERMINATION

Both the user and Dog Date acknowledge that failure to comply with these terms and conditions may result in termination of the agreement between both parties.

In case of non-compliance by the user:

If the user fails to comply with any of the terms set forth in these terms and conditions, Dog Date reserves the right to unilaterally terminate the user's access to and use of the platform. Dog Date may take this action without prior notice, and the User will automatically lose all rights to access and use the platform. Furthermore, Dog Date shall not be liable for any loss of data or information associated with the user's account.

In case of non-compliance by Dog Date:

If Dog Date fails to comply with its obligations under the agreed terms and conditions, the User shall be entitled to terminate the agreement and stop using the platform. The user shall notify Dog Date in writing of the breach and allow a reasonable time for Dog Date to remedy the situation. If Dog Date does not remedy the breach within the set period, the user may proceed with the termination of the agreement.

Termination of the agreement shall not release either party from any obligations and liabilities that have arisen prior to the date of termination.

Continued use of the platform after termination of the agreement by either party shall imply acceptance of the conditions set forth in the terms and conditions in effect at that time.

25. DISPUTE RESOLUTION

Any dispute, claim or controversy arising between a user and Dog Date in connection with these terms and conditions, the use of the platform or the services provided, shall be resolved exclusively through alternative dispute resolution mechanisms, including mediation and arbitration, as detailed below.

First, both parties agree to use their best efforts to resolve any dispute informally. This includes direct communication between the parties involved to identify and address concerns or disagreements quickly and efficiently. Users may contact Dog Date through designated support channels to raise any disputes. The company commits to respond within a reasonable period of time, providing an opportunity to resolve the issue without resorting to formal procedures.

If the parties fail to resolve the dispute informally within thirty (30) days of initial notification of the dispute, the dispute will be submitted to mediation. The mediation shall be conducted before a neutral mediator selected by mutual agreement of the parties. If the parties are unable to agree on a mediator within an additional fifteen (15) days, a mediator shall be appointed through a recognised mediation agency. The costs of the mediation shall be shared equally between the parties, and the mediation shall be conducted in English and at a mutually agreed location or, if both parties agree, through a virtual platform.

If mediation does not result in a resolution satisfactory to both parties, the dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of an internationally recognised body. The arbitration shall be conducted by a single neutral arbitrator, who shall be selected in accordance with the rules of the arbitration body. The place of arbitration shall be in the United Kingdom. The language of the arbitration shall be English.

The arbitrator shall have exclusive authority to resolve the dispute, including determining the applicability and validity of these dispute resolution terms. The arbitrator's decision shall be final and binding on both parties, and may be entered as a judgment in any court of competent jurisdiction. Unless prohibited by applicable law, the parties agree to waive any right to bring the dispute in court or to participate in a class action.

This dispute resolution clause does not preclude Dog Date from seeking injunctive or equitable relief in the event of intellectual property rights infringement, misuse of the platform, or any act that may cause irreparable harm, in which case it may go directly to a court of competent jurisdiction without exhausting alternative dispute resolution mechanisms.

By accepting these terms, users expressly waive any right to a jury trial and agree that all disputes will be resolved in accordance with the procedures set forth in this clause, with the objective of minimising the costs and time associated with formal litigation. The parties assume their own costs associated with mediation and arbitration, unless otherwise agreed or specifically provided by the arbitrator.

26. APPLICABLE LAW AND JURISDICTION

For the purposes of this Terms and Conditions document, the Dog Date platform is a mobile application legally based in the United Kingdom, developed and operated in accordance with the laws of that country. However, the platform is available to users located in different jurisdictions, including, but not limited to, the United Kingdom, the Member States of the European Union, the United States of America, Canada, Australia, New Zealand, India and China. Given this international availability, use of the application may be subject to additional local laws and regulations depending on the country from which the user accesses the services, without prejudice to the provisions set forth below.

Notwithstanding the foregoing, any dispute, claim, controversy or disagreement arising out of or in connection with the access, use or interpretation of these terms and conditions, as well as any contractual or non-contractual matter arising from the use of Dog Date, shall be resolved exclusively in accordance with the substantive and procedural laws of the United Kingdom, to the exclusion of any conflict of law rules that might refer to the application of a different law. The user acknowledges and accepts that any judicial or extrajudicial proceedings related to such disputes shall be subject exclusively to the jurisdiction and exclusive competence of the courts located in the United Kingdom, expressly waiving any other jurisdiction that may correspond to them by reason of their domicile, nationality or any other cause.

Likewise, by accessing and using the platform, users agree to submit to said jurisdiction, acknowledging that this choice of law and jurisdiction is made freely, in an informed manner and is binding, and that it constitutes an essential condition for the use of the services provided by Dog Date. This provision shall not limit the mandatory consumer rights provided for by the applicable legislation in the user's country of residence, in cases where such rights cannot be validly waived by contractual agreement.

27. FINAL PROVISIONS

Use of our platform is conditional upon acceptance of and compliance with all terms and conditions set forth herein. This authorisation to use our services does not extend to jurisdictions where these provisions are not respected or applied.

Our commitment to complying with these terms is strictly governed by applicable laws and legal processes. It is important to note that these terms do not restrict our ability to comply with legal or governmental requirements, including, without limitation, those related to law enforcement and the use of our platform. Information provided or collected in connection with your use of the platform will be subject to these requirements.

In the event that any provision of these terms and conditions shall be declared invalid, illegal or unenforceable by any court or competent authority, such decision shall not affect the validity or enforceability of the remaining provisions. The failure or delay in enforcing any of these terms and conditions by us at any time shall not constitute a waiver of our rights to enforce such provision, or any other provision, in the future.

We reserve all rights not expressly granted herein, while at all times maintaining the protection of and respect for our intellectual property rights and prerogatives.
